Hi all,
In my campaign people can say, "he does
not engage me!" and just move away from enemies.
However the enemy gets a free attack with either
bonus damage or bonus DX. If you survive the
attack, well, I guess he DIDN'T engage you after
all!

Rick,
You too hun? I ran an optional rule like that for a year. If a figure
chose to ignore engagement the figure(s) they ignored got an extra attack
that round. I'm trying to remember when and why I stopped using it. I'm
not sure, don't remember clearly. I think it was because it broke up the
chess-like feel that melee has.

This may be belated on reply, but I think this is an acceptable idea.

I would even go a bit further to apply it to riders on horseback who zip by a player's zone of control but are not stopped by it. Let the unmounted get a swing at the rider as he gallops by. Perhaps both can get a swing at minus DXs. If the rider is hurt, find out if he falls. If he fails his DX, roll again to see if he catches himself. Another failed roll and he falls off his horse next to the unmounted man, but the horse still gallops onward.

Hail Melee,
John Paul
