That's true... except that the problem doesn't necessarily matter, if it only becomes a problem if you try to do something with it, that you would never actually do. It's even less of a problem if you know that doing that would be a problem, and if you can change it if and when you ever do try to do the thing you'd never do with it.
Which, from one way of looking at it, which I think is found almost everywhere you see the phrase "GM discretion" in ITL, is why it's ok to use GM discretion rather than inventing perfect rules systems that cover everything with ultimate consistency.
