Yes, Broadsword is allowed to disengage while not engaged, but not if he had moved more than one hex. So he isn't allowed to disengage in the first place. Now, if the scenario was re-written with this in mind, no, O1 does not get to set vs. charge.

Just like casting a spell, a character may only stand still or move one hex to disengage.
