Test of general MELEE knowledge, NUMBER III
Let's see if anyone can answer this question correctly. First will be a
simple melee set up. Then a situation that is protested by both players.
Finally, how would you rule on it.

Fingoul [f] with a spear charge attacks his enemy [e], who has a small
sheild and a broadsword.

The enemy defends and waits for an opening. The Fingoul misses his charge
attack (on Dx 13). So now the second turn starts. They roll for initiative
and the Fingoul wins. He makes his enemy move first.

The enemy stays put, and a second enemy [e2] runs up moving more than
half his Ma so he can't action this turn. He also has a small sheild and a
broad sword.

Now Fingoul gets to move and this is where the problems start. First
Fingoul tries to shift away from e2 claiming that since e2 can't action this
turn he doesn't really pose a threat, hence he can't really engage.

The GM over rules this, saying e2 still engages Fingoul, and becoming
engaged his movement ends for the turn. All he can do is change his action.

So now the Fingoul dicides to set vs. charge on the new enemy [e2]. So
no matter what the original enemies Dx is this turn fingoul will get to
attack first. Even if the original enemy's Dx is higher. [e] gets Dx +1
because he waited for an opening last turn. On top of that [e] hasn't
attacked yet, so fingoul is not sure what his Dx actually is.
At this point the enemy player tries to claim that Fingoul can't set vs.
charge. Because e2 moved too far to action. Thus he isn't really charge
attacking. That being an action.
As a GM how would you rule?
